Notwithstanding the foregoing arbitration clause, either party may seek preliminary injunctive relief in a court of competent jurisdiction if such relief is necessary to protect its rights or property pending the completion of arbitration. Both parties agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action.

13. Severability and Entire Agreement
